Welcome to Fine Art Form. By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account or using Fine Art Form, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the platform.

2. Account Terms

  • You must be at least 18 years old to create an account.
  • You are responsible for maintaining the security of your account and password.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate and complete information when creating your account.
  • One person or entity may not maintain more than one free account.

3. Content Ownership

Your content is yours. You retain all rights to the artwork images, descriptions, and other content you upload to Fine Art Form. We do not claim ownership of your content.

By uploading content, you grant Fine Art Form a limited license to display, reproduce, and distribute your content solely for the purpose of operating the platform (e.g., displaying your portfolio to visitors, generating thumbnails, creating viewing room presentations).

You represent that you have the right to upload and share all content on your account, and that your content does not infringe on the intellectual property rights of others.

4. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose
  • Upload content that infringes on intellectual property rights
  • Attempt to gain unauthorized access to other accounts or systems
  • Interfere with or disrupt the platform or its infrastructure
  • Use automated tools to scrape, crawl, or extract data from the platform
  • Impersonate another person or entity
  • Upload malicious code, viruses, or harmful content

5. Payment Terms

  • Free accounts have feature and storage limitations as described on our pricing page.
  • Paid subscriptions are billed monthly or annually, depending on your chosen plan.
  • All fees are non-refundable except as required by law or as described in our refund policy.
  • We may change pricing with 30 days notice. Price changes do not affect current billing periods.
  • Payment processing is handled by Stripe. By subscribing, you also agree to Stripe's Terms of Service.

6. Termination

You may cancel your account at any time from your account settings. Upon cancellation:

  • Your public portfolio will be taken offline immediately.
  • Your data will be retained for 30 days to allow for reactivation.
  • After 30 days, your data will be permanently deleted.
  • You may export your data before cancellation.

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

7. Limitation of Liability

Fine Art Form is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
  • We are not responsible for lost profits, data loss, or business interruption.

8. Governing Law

These terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.

9. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes via email or a prominent notice on the platform. Continued use of Fine Art Form after changes constitutes acceptance of the updated terms.
